Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Devon AI website, desktop application, and related paid plans (collectively, the "Service"), operated by Devon AI ("we", "us", or "our"). By using the Service, you agree to these Terms.

1. Eligibility & accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase a paid plan. When you create an account you are responsible for keeping your credentials secure and for all activity that occurs under your account.

2. The Service

Devon AI is a desktop chatbot and codebot. The free desktop application runs on your machine and connects to third-party AI models (GPT, Grok, and Claude) using your own API key. Paid plans provide access to hosted models and account features such as synced chat history.

• The desktop app is licensed, not sold, to you for use with your own AI model API keys.
• Paid features are licensed, not sold, to you for the duration of your plan.

3. Plans, billing & payment

Paid plans are described on our pricing page. Payments are processed by our authorized reseller and merchant of record, Paddle.com. By purchasing, you also agree to Paddle's buyer terms.

• Essential and Pro are billed on a recurring monthly basis and renew automatically until cancelled. Hosted-model token allowances reset daily (UTC).
• Free (Basic) includes 45K tokens per day at no charge.
• You authorize us and Paddle to charge your payment method for applicable fees and taxes.
• You may cancel a recurring subscription at any time; access continues until the end of the paid period.

4. Refunds

Refunds are handled in accordance with our Refund Policy, which forms part of these Terms.

5. Acceptable use

You agree not to misuse the Service. In particular, you will not:

• Use the Service for unlawful, infringing, or harmful purposes;
• Attempt to reverse engineer, resell, or abuse the hosted models or API rate limits;
• Upload content you do not have the rights to, or that violates third-party rights;
• Interfere with or disrupt the integrity or performance of the Service.

6. AI-generated output

Devon generates code and text using machine-learning models. Output may be inaccurate, incomplete, or insecure. You are responsible for reviewing, testing, and validating any output before relying on or deploying it. We make no warranty that generated code is correct or fit for any purpose.

7. Your content

You retain ownership of the code and content you provide to the Service. You grant us a limited license to process it solely to provide the Service. See our Privacy Policy for details on how data is handled.

8. Intellectual property

Except for third-party components and your content, the Service, including its branding and hosted software, is owned by us and protected by applicable laws. These Terms do not grant you any rights to our trademarks.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms. Upon termination, your right to use paid features ends, though the desktop app remains available for use with your own API keys.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes take effect constitutes acceptance.
